What is the McKinney-Vento Act?

Title IX, Part A

Protects the rights of homeless children and youth to receive a free and appropriate public education.

Fundamental rights of Education for Homeless Students:

  • A free, appropriate public education

  • An Education in a mainstream school environment

  • Prompt resolution of disputes regarding educational placement

  • No isolation or stigmatizing due to homelessness

  • Provide the same services offered to other students

  • Participation in federal, state, and local food programs (if criteria are met

  • Continued education in the school of origin or school most accessible, whichever is in the best interest of the child

  • Consider parental requests in determining school assignments
